Terms of Service

These Terms of Service ("Terms") govern your use of the CoastWarn mobile application ("the App") provided by MemoryForge, LLC ("we," "us," or "our"). By downloading, installing, or using CoastWarn, you agree to these Terms.

Web alerts (not live yet)

These Terms cover the iOS app. The text and email signup form on the home page is in local preview and is not open to the public, so no web alert service is being offered under these Terms today. Before that form accepts a real signup, these Terms will be extended to cover text and email delivery, message frequency, the STOP and HELP keywords, unsubscribing, and who bears carrier charges.

Use of the App

CoastWarn provides water level monitoring and notification alerts based on data from the National Oceanic and Atmospheric Administration (NOAA). The App is intended for informational purposes only.

Data Accuracy

Water level data displayed in CoastWarn is sourced from NOAA CO-OPS and may be delayed, incomplete, or inaccurate. NOAA data is provided "as is" by the federal government. We do not independently verify or guarantee the accuracy, reliability, or timeliness of any data displayed in the App.

Notification Delivery

Alerts are delivered as iOS notifications. We are not responsible for delays, delivery failures, or any loss or damage resulting from data transmission over communications networks and facilities, including the internet. Notification delivery depends on factors outside our control, including your device settings, network connectivity, and iOS background task scheduling.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, timely, secure, or error-free
• Water level data will be accurate or complete
• Notifications will be delivered promptly or at all
• The App will meet your specific requirements

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MEMORYFORGE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your use of or inability to use the App
• Any delay or failure in notification delivery
• Inaccurate, delayed, or missing water level data
• Any action or inaction you take based on information provided by the App
• Any property damage, personal injury, or loss of life

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID FOR THE APP.

Your Responsibilities

You acknowledge and agree that:

• CoastWarn is a supplementary information tool, not a safety device
• You will not rely solely on CoastWarn for flood or emergency awareness
• You are responsible for monitoring official National Weather Service warnings and following local emergency management guidance
• You will maintain awareness of your local conditions regardless of notifications received or not received from the App

Purchases

CoastWarn is free to download. Some features, including CoastWarn's own threshold-crossing alerts, are unlocked by a one-time in-app purchase of $19.99 (CoastWarn Pro Lifetime). This is a single, non-recurring payment: nothing renews, there is no billing period, and no cancellation is required. The purchase can be restored on any device signed in to the same Apple Account using the Restore Purchases option in the app. All payments are processed by Apple and are subject to Apple's terms and conditions. Refund requests must be directed to Apple.

Intellectual Property

The App and its original content, features, and functionality are owned by MemoryForge, LLC and are protected by copyright, trademark, and other intellectual property laws.

Termination

We reserve the right to terminate or suspend access to the App at any time, without prior notice, for any reason, including but not limited to a breach of these Terms.

Changes to These Terms

We may update these Terms from time to time. Changes will be reflected on this page with an updated "Last updated" date. Your continued use of CoastWarn after changes are posted constitutes acceptance of the revised Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions.
